Object of the Warranty:
This commercial warranty is offered by vidaXL as a complement to statutory guarantees applicable under Irish law. It ensures prioritized dispatch of ordered products, guaranteeing dispatch within 1 day from the order date.

 

CONDITIONS FOR IMPLEMENTATION OF THE WARRANTY:

1. Warranty Benefits:

1.1 Order Processing Prioritization:

  • 1.1.1 Your order will be prioritized by our team to ensure it is processed and dispatched on time.
  • 1.1.2 Your order will be placed at the top of the queue, ensuring it is processed and handed over to the carrier promptly. This service is especially beneficial during high-demand periods or unforeseen delays.

1.2 Non-compliance with Shipping Guarantee Commitments:

  • 1.2.1 If we fail to meet our shipping guarantee commitments, we will compensate by providing a refund equivalent to 150% of the warranty price paid, issued in the form of a voucher.
  • 1.2.2 For orders containing multiple products, if some items are not dispatched within the promised timeframe (e.g., one business day), the 150% voucher refund will be calculated on a pro-rata basis, reflecting the value of the delayed items in relation to the total order.
2. Exclusions:

2.1 This warranty does not cover the products themselves (repair, replacement, refund, etc.) but is limited solely to the services listed above.

3. Price:

3.1 The price of this shipping warranty is 5% of the total order price.

4. Warranty Duration:

4.1 The warranty is valid from the order date until all products are received or a refund in the form of a coupon for the dispatch warranty is issued.

5. Right of Withdrawal and Shipping Warranty:

5.1 Under Irish law, consumers have a right of withdrawal for online purchases within 14 days, as per the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 (SI No. 484 of 2013).

5.2. In the event of exercising your right of withdrawal for the entire order, the price paid for the shipping warranty will also be refunded, provided the service has not yet been fully performed (i.e., the product has not been shipped).

6. Reminder of Legal Warranties:

6.1 Independently of the commercial warranty, the seller remains bound by statutory warranties under Irish law.

6.2 Legal Warranty (Sale of Goods Act 1893 and Sale of Goods and Supply of Services Act 1980):

  • 6.2.1 Consumers have a right to claim defects within two years from delivery.
  • 6.2.2 In the first six months after delivery, defects are presumed to have existed at the time of delivery unless the seller can prove otherwise.
  • 6.2.3 Consumers can request repair or replacement of defective goods. If these remedies are not possible or reasonable, they may seek a price reduction or contract cancellation.

6.3. Warranty Against Hidden Defects:

  • 6.3.1. Consumers can claim for hidden defects within the statutory period, with the right to cancel the sale or seek a reduction in the sale price.
Additional Information:

This warranty is valid only in Ireland and is subject to the applicable laws of Ireland. In case of a dispute, and failing an amicable solution, Irish courts will have jurisdiction.
